Meeting Minutes, November 13, 2008

Meeting was called to order at 7:11pm

Board members in attendance were:

Item 1- Motion made by Michelle Blouin, seconded by Michelle Coggiola, to approve minutes from October 9, 2008 board meeting. Motion passes.

Received resignation from board letter from Joe Esteve. Board members have decided to accept Giovanni Comes as new board president.

General discussion regarding Campbell lawsuit and whether to pursue or not to pursue counter suit against Campbell since there is a potential to lose more time and money than could be gained.

Motion by Michelle Blouin, seconded by Michelle Coggiola, to not pursue but settle with Campbell to avoid a trial that could potentially cost the Association more than what could be recovered. Instructions to the attorney are to try to settle for a nominal amount. If that is not possible then lets walk away from the lawsuit so that we do not pay the initial claim by Campbell.

Discussion of plate glass insurance settlement and the amount of the attorney's fees, which are between $12,000 and $14,000.

Motion by Michelle Blouin, seconded by Mark Park, to approve plate glass insurance payout to unit owners minus attorney fees, which will be deducted from the settlement amount based on a percentage. The fees will be divided among those owners who will be receiving a payout.

Motion by Michelle Blouin, seconded by Mark Park, that the insurance refund amount will be paid in the form of a check and sent out within 2 weeks. Approved.

Joe received an estimate of $1200 to reseal the pavers surrounding the pool area and walkways. The pavers are in need of cleaning plus this will help in preserving the pavers with the upcoming Concrete Restoration project.

Motion by Michelle Blouin, seconded by Giovanni Comes, to pay for concrete sealing at a cost of $1200 to protect the pavers before the concrete restoration project begins. This money will come out of the Landscape Supplies 2008 operating budget.

26 owners are now signed up for the bank loan. Only 1 owner has not paid any money toward concrete restoration assessment.

There was general discussion about const of taking down screens, disposals and questions about cost of repairs. Screens can be reinstalled if installation is done to the engineer's installation specifications and is permitted.

Bernadette Paris and Michelle Coggiola will be on a bylaws committee to review the current bylaws and will suggest updates. Proposed additions to the by laws include a work-time clause Monday-Friday, 8am - 5pm.

Motion by Giovanni Comes, seconded by Michelle Blouin, to adjourn at 8:45pm. Approved.
